Welcome to KND Community Organisation (“KND”, “we”, “us”, or “our”). These Terms and Conditions govern your use of our services, website, volunteering opportunities, and any interactions with KND. By accessing our services, you agree to be bound by these terms.
Please read these terms carefully before joining any programme, support group, workshop, or volunteering role. If you do not agree with any part of these terms, you should not use our services. These terms apply to all service users, volunteers, donors, website visitors, and anyone who contacts us for advice or support.
KND is a community charity operating in the United Kingdom. Our registered address is 15 Wellbeing Lane, Manchester, M1 2AB, United Kingdom.
In these Terms and Conditions, the following words have specific meanings.
KND services are available to adults aged 18 to 65 who are recovering from long-term illness or mental health challenges. Some services may have additional eligibility criteria, which will be clearly explained during enrolment.
You do not need a formal diagnosis to access most KND services. However, we may ask about your health to ensure we can support you safely and appropriately.
KND reserves the right to decline or terminate services if we believe your needs fall outside our expertise or capacity. In such cases, we will provide alternative signposting to more suitable organisations.
Volunteers must be at least 18 years old. Some volunteering roles may require a Disclosure and Barring Service (DBS) check, which we will arrange and cover the cost of.
KND provides non-clinical, community based support. We are not a medical or healthcare provider. Our coaches, mentors, and support group facilitators are not doctors, psychiatrists, or clinical therapists unless explicitly stated otherwise.
Our services are designed to complement, not replace, professional medical advice. You should always consult your GP or a qualified healthcare professional for medical concerns, diagnosis, or changes to treatment.
If you are in crisis or experiencing suicidal thoughts, please contact emergency services immediately by calling 999 or the Samaritans free on 116 123. Do not rely on KND for emergency support.
KND reserves the right to modify, suspend, or discontinue any service at any time. We will give reasonable notice where possible.
As a service user, you agree to the following responsibilities.
You will provide accurate and honest information about your health, needs, and circumstances. Withholding relevant information may affect our ability to support you safely.
You will treat KND staff, volunteers, and fellow service users with respect and kindness. Aggressive, abusive, or discriminatory behaviour will not be tolerated and may result in immediate termination of services.
You will attend scheduled sessions on time or give at least 24 hours notice of cancellation. Repeated missed appointments without notice may result in your place being offered to someone else.
You will communicate any changes to your health or circumstances that may affect your participation or safety.
You will not use KND services for commercial purposes, solicitation, or any unlawful activity.
You understand that participation in support groups, forums, or group activities requires confidentiality. What is shared in the group stays in the group, with the exception of safeguarding concerns.
Volunteers are the heart of KND. We value your contribution deeply. These terms apply to all volunteering roles.
Volunteering is unpaid. However, KND will reimburse reasonable out of pocket expenses including travel costs up to £10 per day and any necessary equipment or materials.
Volunteers must complete any required training before starting their role. This includes safeguarding training, confidentiality training, and role specific induction.
Volunteers agree to follow KND policies including the Volunteer Code of Conduct, Confidentiality Policy, and Safeguarding Policy. These are available on request.
KND may terminate a volunteer role at any time with or without cause. Volunteers may also step down at any time by giving notice to their volunteer coordinator.
Volunteers who work with vulnerable adults or children must complete a DBS check. A criminal record does not automatically disqualify someone from volunteering. Each case is assessed individually.
Donations are vital to KND’s work. We are grateful for every contribution. These terms apply to all donations and fundraising activities.
All donations are voluntary. There is no charge for any KND service. You can withdraw a one-time donation within 14 days by contacting us. Recurring donations can be cancelled at any time by emailing info@domain.com.
Gift Aid declarations allow KND to claim an extra 25p for every £1 you donate at no cost to you. By selecting Gift Aid, you confirm you are a UK taxpayer and have paid enough Income Tax or Capital Gains Tax to cover the claim.
KND reserves the right to refuse or return any donation. This includes donations from sources that conflict with our charitable objectives or values.
Fundraising events organised by third parties must be approved by KND in advance. We reserve the right to withdraw approval if fundraising activities damage our reputation or breach charity law.
All funds raised for KND must be paid to us within 30 days of the event or campaign end date.
Your use of the KND website is subject to these terms and our Privacy Policy.
You may browse and access publicly available content without creating an account. Some features, such as forums or service booking, require registration.
You agree not to upload, post, or share any content that is unlawful, defamatory, harassing, abusive, threatening, obscene, or otherwise objectionable. We reserve the right to remove any user generated content without notice.
You retain ownership of content you post on KND forums or social channels. However, you grant KND a non-exclusive, royalty-free, perpetual licence to use, display, and distribute that content for charitable purposes.
You must not attempt to gain unauthorised access to our website, servers, or databases. You must not introduce viruses, malware, or any harmful code.
KND may suspend or terminate your website access if you breach these terms.
KND takes confidentiality very seriously. However, confidentiality has legal limits.
Staff and volunteers will keep your personal and health information private. They will not discuss you with anyone outside KND without your consent.
Exceptions to confidentiality include the following situations. If we believe you are at risk of serious harm to yourself or others. If we believe a child or vulnerable adult is at risk of abuse or neglect. If we are required by law to share information, such as a court order or terrorism prevention.
In these exceptional circumstances, we will share information only with relevant authorities. We will tell you before sharing unless doing so would increase risk.
All service users and volunteers in peer support settings must respect group confidentiality. Breaching another person’s confidentiality may result in removal from the group.
KND provides services in good faith. However, we cannot guarantee specific outcomes or results.
To the fullest extent permitted by UK law, KND excludes liability for any indirect, incidental, or consequential damages arising from your use of our services. This includes loss of income, health deterioration, or emotional distress not directly caused by our negligence.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
You participate in group activities, workshops, and volunteering at your own risk. KND is not liable for injuries or losses occurring during activities outside our direct control, such as travel to and from sessions.
Our total liability to you for any claim arising from these terms or your use of our services is limited to £500.
KND is committed to safeguarding all service users and volunteers. We have a designated Safeguarding Lead who can be reached at info@domain.com.
If you disclose abuse, neglect, or harm during a session, we are legally required to report this to the relevant authorities. We will support you through this process.
If you arrive at a session under the influence of alcohol or non-prescribed drugs to a degree that risks your safety or others, we may ask you to leave and reschedule.
In a medical emergency, staff or volunteers will call 999 immediately. We will provide first aid only within our training limits.
KND reserves the right to exclude or ban any individual whose behaviour poses a risk to others or disrupts our ability to provide services safely.
All content created by KND, including guides, worksheets, website text, logos, and branding, is owned by KND Community Organisation and protected by UK copyright law.
You may download and print KND resources for your personal, non-commercial use. You may share printed copies with fellow service users or carers.
You may not reproduce, distribute, or sell KND content for commercial purposes without our written permission. You may not modify or create derivative works from our content.
KND logos and trademarks may not be used without explicit written consent. This includes using our logo on fundraising materials or social media without approval.
Forum posts and user comments remain the intellectual property of their authors, but KND retains a licence to display them as described in Section 7.
Our website and resources may contain links to third party websites, services, or organisations. These links are provided for your convenience only.
KND does not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third party. You access third party resources at your own risk.
We recommend you read the terms and privacy policy of any third party website you visit. KND is not liable for any loss or damage arising from your use of third party services.
KND may terminate or suspend your access to services, volunteering, or the website immediately without notice if you breach these terms.
Breaches leading to termination include aggressive behaviour, confidentiality violations, fraud, harassment, or any unlawful activity.
If your services are terminated, we will provide signposting to alternative support where possible. We will not refuse termination based on health status alone.
You may terminate your relationship with KND at any time by contacting us in writing. We will delete your data as described in our Privacy Policy.
KND reserves the right to decline service to anyone who has previously been terminated for serious breaches.
KND may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated effective date.
If we make material changes that affect your rights or obligations, we will notify you directly by email or post. Minor changes, such as clarifications or typographical corrections, will be updated on the website without direct notice.
Continued use of KND services after changes constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using our services.
Please check this page periodically. The effective date at the top indicates when the terms were last revised.
These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from these terms or your use of KND services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you have a complaint about KND or our services, please contact us first at info@domain.com. We will acknowledge your complaint within 5 working days and provide a full response within 20 working days.
If you are unsatisfied with our response, you may contact the Charity Commission or seek mediation through the Centre for Effective Dispute Resolution (CEDR). Court proceedings should be a last resort.
Nothing in these terms affects your statutory rights as a consumer under UK law.
If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these terms.
The remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely achieves the original commercial intent.
These Terms and Conditions, together with our Privacy Policy and any service specific agreements you sign, constitute the entire agreement between you and KND.
They supersede any prior agreements, understandings, or representations, whether written or oral, relating to your use of KND services.
Any waiver of a breach of these terms must be in writing and signed by an authorised representative of KND. A waiver of one breach shall not constitute a waiver of any subsequent breach.
